These Terms and Conditions ("Terms") govern your access to and use of our website, and the purchase of 3D printed products, customized items, and corporate gifting solutions offered by us. By accessing or using this Website, placing an order, or creating an account, you agree to be bound by these Terms. If you do not agree, please discontinue use of the Website.

These Terms are published in accordance with the Information Technology Act, 2000, the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020, and other applicable Indian laws.

1. About Us

www.customproduct.in is an e-commerce platform operated by 1996 Ventures, registered under the laws of India, with its registered office at 2nd Main, 2nd Cross, 4th T Block, Jayanagar, Bangalore 560041 ("Company"). We specialize in custom 3D printed objects and corporate gifting solutions.

2. Eligibility

You must be at least 18 years of age and capable of entering into a legally binding contract under the Indian Contract Act, 1872, to use this Website and place orders. If you are placing an order on behalf of a company or organization (e.g., corporate gifting), you represent that you have the authority to bind that entity.

3. Order Placement

• You may place orders as a guest by providing accurate contact, shipping, and payment information.
• You are responsible for the accuracy of the information provided at checkout.
• We reserve the right to refuse or cancel orders found to be fraudulent, incomplete, or in violation of these Terms.

4. Products and Custom Orders

4.1 Product Descriptions

We strive to accurately describe products, materials, dimensions, and colors. However, due to the nature of 3D printing and photographic/display variations, slight differences in color, texture, or finish between the displayed image and the delivered product may occur and do not constitute a defect.

4.2 Customization and Design Uploads

• For custom/personalized products, you are solely responsible for the accuracy, quality, and legality of any design files, images, logos, text, or artwork ("Custom Content") you upload.
• By uploading Custom Content, you represent and warrant that you own or have obtained all necessary rights, licenses, and permissions to use such content, and that it does not infringe any third party's intellectual property, trademark, copyright, or other rights.
• We reserve the right to refuse any order containing content that is unlawful, offensive, infringing, or otherwise objectionable, at our sole discretion.
• Minor adjustments to uploaded designs (e.g., for print feasibility) may be made by our production team; significant changes will be communicated to you for approval before production.

4.3 Corporate Gifting Orders

• Bulk and corporate gifting orders may be subject to separate quotations, minimum order quantities, customized pricing, and delivery timelines agreed upon with the corporate client.
• Recipient details (names, addresses) provided by the corporate client for gift dispatch are the client's responsibility to ensure are accurate and consented to be shared for delivery purposes.

4.4 Production Time

Due to the made-to-order nature of 3D printed and customized products, production and delivery timelines may differ from standard stocked items. Estimated timelines will be communicated at the time of order confirmation and are not guaranteed unless expressly stated in writing.

5. Pricing and Payment

• All prices listed on the Website are in Indian Rupees (INR) and are inclusive/exclusive of applicable GST as indicated at checkout.
• We reserve the right to modify prices at any time without prior notice; however, orders already confirmed will be honored at the price agreed at the time of order.
• Payments are processed securely through our payment gateway partner, IDFC FIRST Bank. By making a payment, you agree to IDFC FIRST Bank's applicable terms governing the transaction.
• We do not store your card, UPI, or net-banking credentials; these are handled directly by IDFC FIRST Bank's secure payment infrastructure.
• Orders will be processed only upon successful payment confirmation, unless otherwise agreed (e.g., for corporate credit terms).
• In case of payment failure after debit, refunds (if applicable) will be processed as per Section 8.

6. Order Confirmation and Cancellation

• An order is confirmed only upon receipt of payment (or advance payment for custom/bulk orders) and issuance of an order confirmation email/SMS.
• Cancellations: Since most products are made-to-order, cancellation requests must be made within 24 hours of order placement and before production has commenced. Once production has started, orders generally cannot be cancelled.
• We reserve the right to cancel any order due to product unavailability, pricing errors, suspected fraud, or inability to fulfill custom specifications, with a full refund issued in such cases.

7. Shipping and Delivery

• Delivery timelines provided are estimates and may vary due to production schedules, courier delays, or circumstances beyond our control (see Section 12).
• Risk of loss and title for products pass to you upon delivery to the courier/logistics partner, or as otherwise required under applicable consumer protection law.
• Shipping charges, if applicable, will be displayed at checkout.
• For corporate gifting bulk orders, delivery to multiple addresses may be subject to additional logistics charges and lead time.

8. Returns, Refunds, and Replacements

• Given the customized and made-to-order nature of most products, customized and personalized items are generally not eligible for return or exchange, except in cases of manufacturing defects, damage during transit, or delivery of a product materially different from what was ordered.
• Claims for defects or damage must be raised within 48 hours of delivery, along with photographic evidence, by contacting our customer support.
• Approved refunds will be processed to the original payment method via the IDFC FIRST Bank payment gateway within 7–10 business days.
• Non-customized/standard catalog items (if any) may be eligible for return within 7 days of delivery, subject to the product being unused and in original packaging.

9. Intellectual Property

• All content on the Website — including logos, designs, graphics, text, and software — is the property of the Company or its licensors and is protected under Indian and international intellectual property laws.
• Except for content you upload for customization, you may not reproduce, distribute, or create derivative works from Website content without our prior written consent.
• By uploading Custom Content, you grant us a limited, non-exclusive license to use, reproduce, and modify such content solely for the purpose of fulfilling your order.

10. Prohibited Uses

You agree not to:

• Use the Website for any unlawful purpose or in violation of these Terms;
• Upload content that is defamatory, obscene, infringing, or violates any third-party rights;
• Attempt to gain unauthorized access to our systems, servers, or data;
• Use automated means (bots, scrapers) to access the Website without our permission;
• Engage in fraudulent transactions or misuse the payment gateway.

11. Limitation of Liability

To the maximum extent permitted under applicable law:

• The Company shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of the Website or products purchased.
• Our total liability for any claim arising out of an order shall not exceed the amount paid by you for that specific order.
• We are not liable for delays or failures in performance resulting from causes beyond our reasonable control, including courier delays, third-party payment gateway issues, or force majeure events (see Section 12).

Nothing in these Terms limits liability that cannot be excluded under the Consumer Protection Act, 2019, or other mandatory Indian law.

12. Force Majeure

We shall not be liable for any failure or delay in performance due to events beyond our reasonable control, including but not limited to natural disasters, strikes, government restrictions, pandemics, courier/logistics disruptions, or technical failures of third-party service providers (including the payment gateway).

13. Third-Party Services

Our Website integrates with third-party service providers, including IDFC FIRST Bank (payment processing) and logistics/courier partners. Your use of such third-party services may be subject to their own terms and conditions, over which we have no control and for which we disclaim liability, except to the extent required by law.

14. Privacy

Your use of the Website is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

16. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Website with an updated "Last Updated" date. Continued use of the Website after changes constitutes your acceptance of the revised Terms.

17. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Subject to the Consumer Protection Act, 2019 (which allows consumers to file complaints in the jurisdiction of their residence), any other disputes shall be subject to the exclusive jurisdiction of the courts at Bengaluru.

Parties may also mutually agree to resolve disputes through arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration at Bengaluru.
